It is ordered that the opinion filed herein on August 25, 2011, be modified as follows:

The word mother in line 8 of the last paragraph on page 7 should be changed to guardian, and that line should read: too would amount to no more than a claim that guardian lied to the trial court in making.

There is no change in judgment.
