Dewdney v. State

District Court of Appeal of Florida, Second District
Aug 11, 2000
772 So. 2d 17 (Fla. Dist. Ct. App. 2000)

Opinion

No. 2D99-3436

Opinion filed August 11, 2000.

Appeal from the Circuit Court for Polk County; Randall G. McDonald, Judge.

James Marion Moorman, Public Defender, and Timothy J. Ferreri, Assistant Public Defender, Bartow, for Appellant.

Robert A. Butterworth, Attorney General, Tallahassee, and Richard M. Fishkin, Assistant Attorney General, Tampa, for Appellee.

Michael Dewdney appeals his conviction for attempted second-degree murder following a jury's verdict of guilt. We find no merit in his argument that the trial court erred in denying his motion for judgment of acquittal. Likewise, we find no error in his conviction for attempted second-degree murder which we continue to recognize as a viable offense. See Smith v. State, 25 Fla. L. Weekly D1508 (Fla. 2d DCA June 21, 2000). Accordingly, we affirm.

Affirmed.

CAMPBELL, A.C.J., and BLUE, J., Concur.
