Michelle Lynette DeVellis v. David M DeVellis
LC No. 15-000670-DM
Mark T. Boonstra, Presiding Judge Jane E. Markey, Kathleen A. Feeney, Judges
ORDER
The Court previously remanded this matter to the Washtenaw Circuit Court "for detailed factual findings and an articulation of the basis for its determination of the amount of income to impute to defendant." DeVellis v DeVellis, unpublished order of the Court of Appeals, entered October 5, 2023 (Docket No. 365216). The trial court was ordered to conclude the proceedings on remand within 56 days of the date of the order and to make an appropriate determination on the record. Id. More than 56 days have passed since the entry of the Court's order, and the trial court has not concluded the remand proceedings.
The Court now orders the trial court to conclude the proceedings on remand within 21 days of the date of this order. Plaintiff shall schedule a hearing at which the trial court shall place on the record its detailed factual findings and the articulation of the basis for its determination of the amount of income to impute to defendant. Within 7 days of the date of this order, plaintiff shall inform the Court of the date of the hearing. A failure of plaintiff to inform the Court of the hearing date may result in an order denying the delayed application for leave to appeal.
Defendant shall file with this Court a transcript of the proceedings on remand, and any related orders or opinions, within 14 days after the conclusion of the proceedings. The Court retains jurisdiction.
