Deutsche Bank v. McGarry

United States District Court, N.D. Illinois
Jun 28, 2004
No. 03 C 8273 (N.D. Ill. Jun. 28, 2004)

Opinion

No. 03 C 8273.

June 28, 2004

Upon hearing, the Court finds that defendant Dennis W. McGarry has proven that he has a substantial likelihood of closing a sale on the foreclosure property, that sale of the property will cause irreparable injury, that the balance of harm weighs heavily in favor of defendant and that the public interest is consistent with a stay of the courtordered sale of the property. Therefore, the Court orders that the special commissioner's sale of the property at 2444 West Dakin Street, Chicago, Illinois, (Cook County P.I.N. 13-24-202-020-0000) be stayed until July 20, 2004.
