DECISION & ORDER ON MOTION
Appeals from an order and a judgment of the Supreme Court, Kings County, dated February 9, 2023, and March 20, 2023, respectively, which were deemed dismissed pursuant to 22 NYCRR 1250.10(a). Motion by the respondent to dismiss the appeal from the order on the ground that the right of direct appeal terminated upon entry in the above-entitled action of the judgment and on the ground that no appeal lies from an order entered upon default. Motion by the respondent to dismiss the appeal from the judgment on the ground that no appeal lies from a judgment entered upon default.
Upon the papers filed in support of the motions and no papers having been filed in opposition or in relation thereto, it is
ORDERED that the motions are denied as academic.
