Vincent James DeSimone Petitioner v. Commissioner of Internal Revenue Respondent

ORDER

Maurice B. Foley Chief Judge

On January 6, 2022, respondent filed in this case a motion to close on ground of duplication. Respondent asserts therein that this case is a duplicate of petitioner's case at Docket No. 23613-21 as, in both cases, petitioner seeks review of a notice of deficiency, dated June 24, 2021, issued for petitioner's 2017 tax year. Respondent further states that petitioner does not object to the granting of the motion. Upon review of the records in this case and petitioner's case at Docket No. 23613-21, it appears that respondent's motion is well-supported.

On February 2, 2022, respondent's counsel, Daniel V. Triplett, filed a motion to withdraw as counsel. At the present time, Daniel V. Triplett is the only counsel of record for respondent.

Upon due consideration, it is

ORDERED that respondent's motion to close on ground of duplication is granted and this case is closed on the ground of duplication with respect to petitioner's case at Docket No. 23613-21. It is further

ORDERED that the motion to withdraw as counsel is denied as moot.
