District Court of Appeal of Florida, Second District
Nov 10, 1982
421 So. 2d 782 (Fla. Dist. Ct. App. 1982)

Opinion

No. 82-617.

November 10, 1982.

Appeal from Circuit Court, Lee County; R. Wallace Pack, Judge.

Jerry Hill, Public Defender, and John T. Kilcrease, Jr., Asst. Public Defender, Bartow, for appellant.

Joe DeShields, pro se.

Jim Smith, Atty. Gen., Tallahassee, and Michael A. Palecki, Asst. Atty. Gen., Tampa, for appellee.

The judgment and sentence is affirmed. However, that portion of the court's order requiring appellant to pay $2.00 court costs and $10.00 to the Victim's Crime Compensation Trust Fund is stricken because the appellant was found insolvent by the trial court. Engle v. State, 407 So.2d 641 (Fla. 2d DCA 1981).

GRIMES, A.C.J., and SCHEB and CAMPBELL, JJ., concur.
