Order modified by inserting a provision requiring the defendant, as the condition of the new trial, to pay the costs of the trial already had, and all disbursements in the action to the date of the order, and as modified order affirmed, without costs. No opinion. Hirschberg, P.J., Bartlett, Woodward, Jenks and Rich, JJ., concurred.
