ORDER

The Court, having reviewed the Report and Recommendation of Judge Theresa L. Fricke, United States Magistrate Judge, objections to the report and recommendation, if any, and the remaining record, does hereby find and ORDER:

1. the Court adopts the Report and Recommendation;
2. plaintiff's claims against defendant Elissa Brine, Wesley Richard, and Richard Weyrich are dismissed with prejudice and without leave to amend;
4. plaintiff's remaining claims as to the remaining defendants are dismissed without prejudice and with leave to amend;
5. plaintiff shall have 45 days from the date of this Order to file a proposed amended complaint subject to the Court's review; and
6. the Clerk is directed to send a copy of this Order to the parties in this action.
