DECISION & ORDER ON MOTION
Motion by appellant to vacate an order of this court dated May 15, 2023, which dismissed an appeal from an order of the City Court of Yonkers, Westchester County, entered September 23, 2022. Separate motion by respondent for leave to file late opposition.
Upon the papers filed in support of the motion and no papers having been filed in opposition thereto, it is
ORDERED that the motions are consolidated for disposition; and it is further, ORDERED that the motion is denied with leave to renew by appellant filing with the court an affidavit/affirmation setting forth potential merit to the appeal on or before May 28, 2024; and it is further, ORDERED that respondent's motion to file late opposition is denied as moot.
