Jonathan Ray DEPUE, Appellant v. The STATE of Texas, Appellee

From the 227th Judicial District Court, Bexar County, Texas
Trial Court No. 2006CR10950B
Honorable Philip A. Kazen, Jr., Judge Presiding

ORDER

Appellant seeks to appeal an order denying a motion for appointment of counsel for a post-conviction writ of habeas corpus. In recognition that this court does not have jurisdiction over post-conviction habeas corpus proceedings relating to felony convictions, the motion stated appellant sought to appeal to the Texas Court of Criminal Appeals; however, the trial court clerk mistakenly filed a clerk's record in this court relating to appellant's appeal. See TEX. CODE CRIM. PROC. 11.07. It is therefore ORDERED that appeal number 04-17-00357-CR is ADMINISTRATIVELY CLOSED. The clerk of this court is directed to forward a copy of this order with the clerk's record to the Texas Court of Criminal Appeals.

IN WITNESS WHEREOF, I have hereunto set my hand and affixed the seal of the said court on this 13th day of June, 2017.
