WILLIAM A. DEPIETRI & BETH ANN DEPIETRI, Petitioners v. COMMISSIONER OF INTERNAL REVENUE, Respondent

ORDER

Elizabeth A. Copeland Judge

This case is consolidated with Docket No. 2182-22, both of which are currently set for trial at the Trial Session of the Court scheduled to commence on June 5, 2023, in Boston, Massachusetts.

On March 15, 2023, the parties filed with the Court a Joint Motion for Continuance of Trial (Index No. 10). On March 16, 2023, the parties filed two additional copies of the Joint Motion for Continuance of Trial (Index Nos. 11 and 12). All three motions are identical in nature. The parties filed a Joint Motion for Continuance of Trial in the lead case (Docket No. 2182-22) on March 16, 2023. For this reason, the Court will strike two of the duplicative filings in this case.

Upon due consideration, and for cause, it is

ORDERED that the parties' Joint Motion for Continuance of Trial at Index No. 10,filed on March 15, 2023, is hereby stricken from the record. It is further

ORDERED that the parties' Joint Motion for Continuance of Trial at Index No. 12, filed on March 16, 2023, is hereby stricken from the record. It is further

ORDERED that the parties' Joint Motion for Continuance of Trial at Index No.

11,filed on March 16, 2023, is granted in that this case is stricken for trial from the June 5, 2023, Trial Session of the Court in Boston, Massachusetts, and is restored to the general docket with the lead case (Docket No. 2182-22).
