Department of HRS/Juvenile Justice v. Sickinger

District Court of Appeal of Florida, First District
May 13, 1997
693 So. 2d 128 (Fla. Dist. Ct. App. 1997)

Opinion

Case No. 96-965

Opinion filed May 13, 1997.

An appeal from Judge of Compensation Claims Joseph Willis, Judge.

David A. McCranie, Jacksonville, for Appellants.

John P. Brooks, Altamonte Springs, for Appellee.

The judge of compensation claims (JCC) did not have jurisdiction to decide appellee's claim for "full-pay status" pursuant to section 440.15(11), Florida Statutes (1993). See Williams v. City of Ft. Walton Beach, No. 96-2124 (Fla. 1st DCA April 16, 1997). Accordingly, we reverse the order on appeal and remand this case to the JCC with directions that it be dismissed.

KAHN, DAVIS BENTON, JJ., CONCUR.
