The issue raised by the Department of Health and Rehabilitative Services is identical to that in Department of Health and Rehabilitative Services v. Cole, 574 So.2d 160 (Fla. 5th DCA 1990). For the reasons announced in that opinion, we reverse the trial court's award of attorney's fees and costs in favor of Ronald I. Cole.

REVERSED.
