No. 49S02-1106-CR-340 (Ind. Jun. 20, 2011)

Opinion

No. 49S02-1106-CR-340.

June 20, 2011.

Court of Appeals Cause No. 49A02-1001-CR-89.

Marion Superior Court Cause No. 49F08-0807-CM-168596.

ORDER

Appellant, by counsel, Deborah Markisohn, files a "Verified Motion To Modify Caption."

Apparently, Appellant's name had been misspelled in the Notice of Appeal, and the misspelling was used when the docket was created. In addition, the misspelled name was used by the attorneys in all the briefs that were filed in the appeal, in the Court of Appeals opinion, and in the opinion this Court handed down on June 14, 2011. The motion requests that the spelling of Appellant's name be changed from "Denzel" to "Denzel."

Being duly advised, the Clerk is directed to change the docket to reflect that Appellant's last name is "Denzel." In addition, the Court will hand down a new version of the opinion with the spelling of the name changed. For all other purposes, such as the calculation of the due date of any document, the date the decision was filed remains June 14, 2011.

The Clerk is directed to send a copy of this order to all counsel of record and to Thomson/West. Thomson/West is directed to publish the new version of the opinion.

Done at Indianapolis, Indiana, this 20 th day of June, 2011.
