In a negligence action to recover damages for personal injuries, the defendant appeals from an order of the Supreme Court, Nassau County, dated June 15, 1960, granting plaintiffs' motion for summary judgment and for an assessment of damages, pursuant to rule 113 of the Rules of Civil Practice. Order affirmed, with $10 costs and disbursements. No opinion. Beldock, Acting P.J., Ughetta, Kleinfeld, Christ and Pette, JJ., concur.
