On March 15, 2023, respondent filed a Motion for Summary Judgment in which petitioner opposes. The case is calendared for remote hearing on the Court's May 15, 2023, New York City, New York trial session at a date and time certain on Friday, May 19, 2023, at 10:00a.m. On May 9, 2023, the Court held a status conference call with the parties. At the conclusion of the call, the parties represented that a hearing would no longer be necessary and would instead consider the possibility of filing a motion under Rule 122.

Upon due consideration, it is ORDERED that respondent's Motion for Summary Judgment is taken under advisement. It is further

ORDERED that the hearing on respondent's Motion for Summary Judgment and this case are stricken for trial on the Court's May 19, 2023, New York City, New York remote trial session and is continued. It is further

ORDERED that jurisdiction is retained by the undersigned over this case.
