MEMORANDUM OPINION

Memorandum Opinion by Justice Hinojosa

Appellant, Daniel Garcia Deluna a/k/a Daniel De Luna a/k/a Danny Garcia a/k/a Daniel Garcia De Luna, has filed a "Motion to Withdraw Appeal," which the Court construes as a motion to dismiss the appeal. See TEX. R. APP. P. 42.2(a) ("Voluntary Dismissal in Criminal Cases"). The motion and its attachment are signed by appellant and his attorney in compliance with Texas Rule of Appellate Procedure 42.2. See id. Without passing on the merits of the case, we GRANT the motion to dismiss and DISMISS the appeal. Having dismissed the appeal at appellant's request, no motion for rehearing will be entertained, and our mandate will issue forthwith.
