In an action by a broker against the vendor, William Rimeik, to recover real estate brokerage commissions, in which the vendor served a third-party complaint against the vendees, the vendor, as defendant and third-party plaintiff, appeals from a judgment of the County Court, Suffolk County, entered May 12, 1958, upon the decision of the court after a nonjury trial, in favor of the plaintiff broker for $1,509.98 against the vendor, and dismissing the vendor's third-party complaint against the vendees as third-party defendants. Judgment affirmed, with costs. No opinion. Nolan, P.J., Beldock, Ughetta, Kleinfeld and Brennan, JJ., concur.
