Opinion

NO. 7:07-cv-19 (HL).

ORDER

Plaintiff FLOYD DELOACH has filed a pro se complaint under 42 U.S.C. § 1983. He also seeks leave to proceed without prepayment of the $350.00 filing fee or security therefor pursuant to 28 U.S.C. § 1915(a). Based on plaintiff's submissions, the Court finds that plaintiff is unable to prepay the filing fee. Accordingly, the Court GRANTS plaintiff's motion to proceed in forma pauperis and waives the initial partial filing fee pursuant to 28 U.S.C. § 1915(b)(1). However, plaintiff must nevertheless pay the full amount of the $350.00 filing fee, as explained later in this order.

While on parole, plaintiff was charged with the sale of cocaine, resulting in his imprisonment on October 18, 2005. Plaintiff was convicted on the new drug charge in November 2006 and apparently is awaiting transfer to the Georgia Department of Corrections from the Lowndes County Jail ("LCJ"), where he is presently confined. In this action, plaintiff sues the Clerk of Court of Lowndes County, Georgia, and four employees of the LCJ. Plaintiff claims that the Clerk, defendant Sara L. Crow, "knowingly and willfully withheld [plaintiff's] commitment orders" from the Georgia Department of Corrections under the directions of the four LCJ defendants, Captain Yeager, Lieutenant Keene, Lieutenant Elkins, and Captain Peete. According to plaintiff, the defendants are using the commitment process to retain him at the Lowndes County Jail, ostensibly in order to deny plaintiff medical treatment. Plaintiff files this action seeking compensatory and punitive damages.

Plaintiff is presently litigating, among other issues, the denial of proper medical treatment at the LCJ in the following lawsuits: Deloach v. Paulk, et al. , 7:06-cv-44 (HL); Deloach v. Lewis, et al. , 7:06-cv-106 (HL); Deloach v. Crews, et al. , 7:06-cv-123 (HL); Deloach v. Elkins, et al. , 7:07-cv-1 (HL); Deloach v. Elkins, et al. , 7:07-cv-7 (HL); and Deloach v. Lewis, et al. , 7:07-cv-15 (HL). The issue in the instant case is not about the denial of medical treatment as such, as plaintiff has ample opportunity to address that issue in the aforementioned six cases.

Although plaintiff provides little factual support for his claim that the named defendants were responsible for the delay in his transfer to the Georgia Department of Corrections, construing the complaint liberally and in favor of plaintiff, the Court will allow said claim to proceed. Accordingly, it is HEREBY ORDERED AND DIRECTED that service of all pleadings be made as provided by law upon the defendants, and that the defendants file a Waiver of Reply, an Answer, or such other response as may be appropriate under Rule 12 of the FEDERAL RULES OF CIVIL PROCEDURE, 28 U.S.C. § 1915, and the Prison Litigation Reform Act .

It is further ORDERED AND DIRECTED that a copy of this order be served upon plaintiff's custodian, if any.
