Michael J. DeLitta; and DeLCom Properties, LLC, Appellants v. Nancy Schaefer, Appellee
FROM THE DISTRICT COURT OF TRAVIS COUNTY, 201ST JUDICIAL DISTRICT
NO. D-1-GN-13-003516, HONORABLE AMY CLARK MEACHUM, JUDGE PRESIDINGMEMORANDUM OPINION
PER CURIAM
Previously, on the parties' joint motion, we abated this appeal in order to allow the parties to finalize settlement negotiations. We subsequently extended the abatement period to March 1, 2016, so that a hearing could be held on appellee's motion to enforce the parties' settlement agreement. We directed the parties to file either a status report or a motion to dismiss by that date.
Appellee's counsel has filed a status report informing the Court that the trial court has now heard appellee's motion but has not yet signed a final judgment. Consequently, appellee requests that we extend the abatement period. While appellants did not join in the filing of the status report, they have not filed any opposition to appellee's request.
We will abate the appeal until May 2, 2016. All appellate deadlines will be tolled during the period of abatement. The parties are instructed to file either a status report or a motion to dismiss the appeal on or before May 2, 2016. Before Justices Puryear, Goodwin, and Field Abated Filed: April 1, 2016
