Motion to strike video evidence from record on appeal or, in the alternative, to withdraw brief of respondent New York City Transit Authority and for extension of time to refile said brief.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the motion to strike is denied, without costs, and it is further

ORDERED that the motion to withdraw the brief of respondent New York City Transit Authority and for an extension of time to refile said brief is granted, without costs, and the time is extended to November 17, 2023. The reply brief, if any, shall be filed and served on or before November 27, 2023.
