FINDINGS, CONCLUSIONS AND RECOMMENDATION OF UNITED STATES MAGISTRATE JUDGE


Pursuant to the order filed by the District Court on April 25, 2002, Petitioner's request to have this case reviewed de novo by the Chief Judge of the Northern District of Texas which he filed on December 12, 2001, has been referred to the magistrate judge for recommendation.

The motion (request) is frivolous. The District Court to whom this case was assigned reviewed the magistrate judge's findings and conclusions filed on November 1, 2001, de novo and adopted the recommendation on November 20, 2001. The provisions of 28 U.S.C. § 2254 and § 636(b)(1)(B) and (C) provide no other avenue of relief at the district court level

RECOMMENDATION:

It is recommended that the District Court file its order denying Petitioner's request.
