ORDER

Patrick J. Urda Judge.

On July 19, 2022, petitioner Del Monte LLC, Dev X Investment 2015, LLC, Tax Matters Partner (Del Monte LLC) filed a motion to calendar, which the Commissioner opposed. A motion for partial summary judgment is currently pending before the Court, and the resolution of that motion will have repercussions for the length and focus of any trial in this case. We will accordingly deny the motion to calendar pending resolution of the motion for partial summary judgment so that the parties and the Court may have a clearer understanding of the nature of trial before scheduling a concrete amount of time. It is therefore

ORDERED that Del Monte LLC's motion to calendar is denied without prejudice. It is further

ORDERED that the parties shall file a joint status report within two weeks after the resolution of the motion for partial summary judgment, proposing potential trial dates.
