At the request of counsel for the Commissioner, the Court held a conference call with the parties on October 13, 2023. The conversation addressed the petitioners' desire to depose a certain IRS employee. In light of the discussion, it is
ORDERED that, on or before October 23, 2023, petitioners shall file a motion to take deposition pursuant to Rule 74(c)(3), specifically of the individual discussed on our conference call. It is further
ORDERED that, on or before November 2, 2023, the Commissioner shall file a response to the petitioners' motion as referenced above.
