Peter DeFiIippis v. Redford Police Department

LC No. 20-015497-AV

ORDER

ELIZABETH L. GLEICHER JUDGE.

The motion to disqualify Judge Thomas C. Cameron filed by plaintiff Peter DeFilippis has been referred to the Chief Judge as required by MCR 2.003(D)(3)(a)(i), and after de novo review the motion is DENIED.

A judge must be disqualified from hearing a case in which he or she cannot act impartially or is biased against a party. MCR 2.003(C)(1)(a). Judicial rulings, standing alone, rarely afford a valid basis for establishing bias requiring disqualification. Kern v Kern-Koskela, 320 Mich.App. 212, 231-32; 905 N.W.2d 453 (2017). Plaintiffs motion, brief and exhibits do not provide any evidence of bias or prejudice, or reasonably suggest that Judge Cameron is unable to impartially carry out his judicial responsibilities. Nor has plaintiff submitted any substantive argument establishing an alternate ground for disqualification under the Code of Judicial Conduct, MCJC 1 or MCR 2.003(C)(1).

Because plaintiff has presented no basis for disqualifying Judge Thomas C. Cameron, the motion to disqualify is DENIED.
