Defeo v. Civitano

Appellate Division of the Supreme Court of New York, Second Department
Apr 7, 2003
304 A.D.2d 520 (N.Y. App. Div. 2003)

Opinion

2002-03407

Submitted March 19, 2003.

April 7, 2003.

In an action to recover damages for personal injuries, etc., the plaintiffs appeal, as limited by their brief, from so much of an order of the Supreme Court, Westchester County (Donovan, J.), entered March 28, 2002, as granted the defendants' motion to vacate a judgment entered upon a purported general release.

Gary Mitchell Gash, White Plains, N.Y. (Pollack Pollack Isaac DeCicco, [Brian J. Isaac] of counsel), for appellants.

O'Connor, McGuinness, Conte, Doyle Oleson, White Plains, N.Y. (Montgomery L. Effinger of counsel), for respondents.

Before: MYRIAM J. ALTMAN, J.P., NANCY E. SMITH, THOMAS A. ADAMS, BARRY A. COZIER, JJ.

DECISION ORDER

ORDERED that the order is affirmed insofar as appealed from, with costs.

The purported general release was not binding upon the individual defendants because they did not execute it (see CPLR 2104; Klein v. Mount Sinai Hosp., 61 N.Y.2d 865). Accordingly, the Supreme Court properly vacated the judgment entered upon the purported release (see Mezatesta v. Oswego Mut. Fire Ins. Co., 58 A.D.2d 739).

ALTMAN, J.P., SMITH, ADAMS and COZIER, JJ., concur.
