The order denying appellant's motion for new trial is affirmed without prejudice to his filing of a motion for post conviction relief pursuant to Florida Rule of Criminal Procedure 3.850, if he is not barred from doing so under the applicable rules.

AFFIRMED WITHOUT PREJUDICE.
