ASA DAY DEBUCK & HEATHER LORRAINE DEBUCK, Petitioners v. COMMISSIONER OF INTERNAL REVENUE, Respondent
ORDER
Joseph Robert Goeke Judge
On August 12, 2024, respondent filed a status report. By Order served June 11, 2024, the Court directed petitioners to file with the Court all documents they have in support of the claimed deductions with a declaration stating petitioners' position and other facts in support of the claimed deductions on or before July 11, 2024. As of the service date of this Order, the Court has not received a declaration, affidavit nor any documents from petitioners to support their deductions. Accordingly, the Court is predisposed to accept a decision document from respondent based upon respondent's concessions and dismiss this case for failure to properly prosecute. Upon due consideration of the foregoing, it is
ORDERED that respondent is directed on or before October 11, 2024, to file with the Court a proposed decision document incorporating their prior concessions. It is further
ORDERED that petitioners are directed on or before November 8, 2024, to file with the Court a response to respondent's proposed decision document. Petitioners should state why the Court should not dismiss this case for failure to properly prosecute and enter a decision for the amounts reflected in respondent's proposed decision document. Petitioners are advised that a failure to respond may result in this case being dismissed for failure to properly prosecute and a decision being entered against petitioners.
