On March 8, 2024, the Court held a conference call with the parties and Ms. Debuck indicated that she wished to speak with legal counsel from the Low-Income Tax Clinic and have time to gather her documents. The Court struck this case from March 28, 2024, Pocatello, Idaho Trial Session, retained jurisdiction and ordered a status report on or before June 7, 2024. On June 7, 2024, respondent filed a Status Report informing the Court that respondent provided contact information to the University of Idaho Tax Clinic to petitioners and that petitioners have been unable to focus on this matter at this time. Upon due consideration of the foregoing, it is
ORDERED that petitioners are directed on or before July 11, 2024, to file with the Court all documents they have in support of the claimed deductions with a declaration stating petitioners' position and other facts in support of the claimed deductions. It is further
ORDERED that respondent is directed on or before August 12, 2024, to file with the Court any objections to the admissibility of the documents and state whether the petitioners' declaration causes any change in respondent's position. The Court will rule on the admissibility of the documents. It is further
ORDERED that on or before September 26, 2024, either party may file a motion for summary judgment.
