BARRY J. DEAN & STACY J. DEAN, Petitioners v. COMMISSIONER OF INTERNAL REVENUE, Respondent

ORDER

Kathleen Kerrigan Chief Judge.

Pending in the above-docked matter is a Motion for Entry of Decision, filed February 22, 2023, by petitioners herein. Subsequently, on March 29, 2023, respondent filed a response (albeit in duplicative copies) representing that respondent had no objection to entry of a decision in favor of petitioners and advising that a Proposed Stipulated Decision to that effect had recently been sent to petitioners for signatures.

Accordingly, the premises considered, and to allow an opportunity for the parties to formalize an agreed settlement, it is

ORDERED that, on or before April 24, 2023, either (1) the parties shall submit a Proposed Stipulated Decision resolving this case; or (2) respondent shall file a status report advising as to then-present status of such settlement efforts. It is further

ORDERED that the copy of respondent's just-referenced response filed March 29, 2023, at Docket Entry #9 shall be deemed stricken from the Court's record in this case.
