Motion by the Attorney-General of the State of New York on behalf of Mr. Justice Morrie Slifkin to dismiss appeal from an order of the Supreme Court, Dutchess County, dated July 23, 1973. Motion denied as moot in view of the decision herewith on the appeal. Gulotta, P.J., Martuscello, Latham, Benjamin and Munder, JJ., concur.
