ORDER

Patrick J. Urda Judge.

This case was heard during the Court's March 25, 2024, Boston, Massachusetts trial session and jurisdiction was retained by the undersigned.

On April 2, 2024, the Court issued an Order to Show Cause directing petitioner Edward L. De Pardo to show cause in writing why the Court should not dismiss this case for failure to properly prosecute.

On April 4, 2024, the Court held a conference call with the parties in this case. During the discussion, Mr. De Pardo indicated that he did not receive a notice setting this case for trial but that he was willing to work with counsel for the Commissioner to work together on resolving this case. In light of the discussion, it is

ORDERED that the Court's Order to Show Cause is hereby discharged. It is further

ORDERRED that the Commissioner's motion to dismiss for failure to properly prosecute filed February 29, 2024, is hereby denied without prejudice. It is further

ORDERED that, on or before June 3, 2024, the parties shall file a joint status report (or separate reports, if that is more expedient) describing the then-present status of this case. It is further

ORDERED that the Clerk of the Court shall change Mr. De Pardo's service preference from "electronic" to "paper".
