Present — Glennon, J.P., Cohn, Callahan, Van Voorhis and Shientag, JJ.


Order, so far as appealed from, unanimously modified, with $20 costs and disbursements to appellant, by denying the motion to vacate defendant's notice of examination before trial of plaintiff, and directing such examination of plaintiff to be held in New York City at a reasonable time before the trial of the action, said examination of plaintiff by defendant to precede the examination of defendant by plaintiff. Settle order on notice.
