No. 04-08-00084-CV (Tex. App. Apr. 9, 2008)

Opinion

No. 04-08-00084-CV

Delivered and Filed: April 9, 2008.

Appeal From the County Court at Law No. 2, Bexar County, Texas Trial Court No. 333863, Honorable Irene Rios, Judge Presiding.

Sitting: KAREN ANGELINI, Justice, SANDEE BRYAN MARION, Justice, PHYLIS J. SPEEDLIN, Justice.

MEMORANDUM OPINION

On February 20, 2008, the trial court reporter filed a notification of late reporter's record, stating that the reporter's record had not been filed because appellant failed to pay or make arrangements to pay the reporter's fee for preparing the record and appellant was not entitled to appeal without paying the fee. On February 22, 2008, we ordered appellant to provide written proof to this court within ten (10) days that either (1) the reporter's fee had been paid or arrangements had been made to pay the reporter's fee; or (2) appellant was entitled to appeal without paying the reporter's fee. We warned appellant that if he failed to respond within the time provided, this appeal would be dismissed for want of prosecution. See Tex. R. App. P. 37.3(b).

To date, appellant has failed to respond to this court's order. Accordingly, this appeal is dismissed for want of prosecution. See id.
