AMENDED SCHEDULING ORDER


This Amended Scheduling Order changes the trial setting, deadline for pretrial material, and the date of the final pretrial conference. It does not alter any other dates in the original Scheduling Order or any modifications to those dates agreed to by the parties. The following schedule is established for the disposition of this case:

Pursuant to the Civil Justice Expense Delay Reduction Plan (N.D. Tex. March 1993), 28 U.S.C. §§ 471-82; to the Local Rules of the Northern District of Texas (as modified by this Order); and to Rules 26, 30, 31 and 33 of the Federal Rules of Civil Procedure (as modified by this Order).

1. SUMMARY OF CRITICAL DATES :

TRIAL SETTING MARCH 2005 (4 WEEK DOCKET) DEADLINE FOR PRETRIAL FEBRUARY 11, 2005 MATERIAL FINAL PRETRIAL CONFERENCE MARCH 4, 2005 (10:00 A.M.)

2. PRETRIAL MATERIAL: The following pretrial material must be filed by February 11, 2005:

a. A joint pretrial order which covers each matter listed in Local Rule 7.1 and which states the estimated length of trial and whether the case is jury or non-jury. [ NOTE: If an attorney does not participate in the preparation of the joint pretrial order, the opposing attorney must file a separate pretrial order with an explanation of why the joint order was not submitted (so this Court can impose sanctions, if appropriate).
b. Each party's list of the witnesses — this list must have separate sections for " probable witnesses", " possible witnesses", "experts" and "record custodians"; and it must contain the name, address, and a brief summary of the testimony of each witness.
c. Each party's list of exhibits and designation of portions of depositions to be offered at trial.
d. Each party's requested jury instructions and issues and proposed voir dire questions ; or, if the case is non-jury, each party's proposed findings of fact and conclusions of law.
e. Trial briefs may be filed with the Pretrial Order, but are not required unless specifically requested by the Court.

The parties are to comply with Local Rule 26.2 and Article IV.A of this Court's Judge Specific Procedures with respect to marking and exchanging exhibits. Note: Both the Local Rules and Judge Specific Procedures are available on-line at www.txnd.uscourts.gov.

NOTE: Proposed jury instructions and proposed findings and conclusions for non-jury trials may be submitted on a labeled diskette, in Word Perfect 7.0 format, in addition to the required written material. Each party must, as required by Local Rule 826.2(b), deliver copies of the witness and exhibit lists to the Court Reporter at least 3 days before trial.

3. PRETRIAL CONFERENCE: The final pretrial conference is set for Friday, March 4, 2005 at 10:00 a.m. The attorneys who will conduct the trial must attend, with full authority to enter into agreements concerning matters — e.g., admission of exhibits, stipulations, etc. — that may reduce the time and expense of trial.

4. TRIAL : The trial of this case is set on this Court'sfour-week docket beginning Monday, March 7, 2005.
