Tommy Dale DAY, Appellant v. Melissa Kay DAY, Appellee

From the 150th Judicial District Court, Bexar County, Texas Trial Court No. 2021-CI-08365 Honorable Angelica Jimenez, Judge Presiding

ORDER

LORI I. VALENZUELA, JUSTICE

On September 21, 2023, counsel for appellee filed a motion to withdraw. The motion appears to comply with the requirements of Texas Rule of Appellate Procedure 6.5(a). We GRANT the motion. However we caution that pursuant to our September 20, 2023 order, appellee's brief is due no later than October 2, 2023. Our order further provides that if appellee's brief is not filed by October 2, 2023, the case will be submitted without benefit of an appellee's brief. We accordingly direct appellee's former counsel to Texas Rule of Appellate Procedure 6.5(c), which requires a withdrawing attorney to immediately notify the party in writing, of the briefing deadline if it has not previously been disclosed. We further direct the Clerk of this court to email appellee copies of this order and our September 20, 2023 order.
