On appeal from judgment of Division of Tax Appeals in Department of Taxation and Finance.

Before Judges McGEEHAN, DONGES and COLIE.

Mr. Oliver T. Somerville argued the cause for the appellant.

Mr. George A. Smith ( Messrs. Conkling, Smith Towe, attorneys) argued the cause for the respondent.


Except for the fact that the property of the plaintiff taxpayer is in the Borough of Rutherford and a difference in the amount of the assessment, this case is controlled by the decision of the court filed this day in the case of Dawn Bible Students Association v. Borough of East Rutherford, 2 N.J. Super. 71.

The judgment under review is reversed.
