No. 1D21-3647 (Fla. Dist. Ct. App. Mar. 9, 2022)

Opinion

Barry Trynell Davis Jr., Appellant, v. State of Florida, Appellee.

Barry Trynell Davis Jr., pro se, Appellant. Ashley Moody, Attorney General, Tallahassee, for Appellee.

Not final until disposition of any timely and authorized motion under Fla. R. App. P. 9.330 or 9.331.

On appeal from the Circuit Court for Walton County. Kelvin C. Wells, Judge.

Barry Trynell Davis Jr., pro se, Appellant.

Ashley Moody, Attorney General, Tallahassee, for Appellee.

Per Curiam.

Because the notice of appeal was not timely filed, the Court dismisses this appeal for lack of jurisdiction. See Fla. R. App. P. 9.110(b); Fla. R. App. P. 9.141(b)(1). Florida Rule of Appellate Procedure 2.514(b), which allows an additional five days for mailing when "a party may or must act within a specified time after service . . ." does not apply because Rule 9.110(b) requires a notice of appeal to be filed, not served.

B.L. THOMAS, BILBREY, and WINOKUR, JJ., concur.
