ORDER
After the original trial court granted a petition for discretionary transfer (certification as an adult), appellant's cases were transferred from the 304th Judicial District Court to the 204th Judicial District Court. Although his guilt was initially deferred and he was placed on community supervision in each case, the State later moved to proceed with adjudication of guilt. In October 2016, appellant was found guilty and sentenced to twenty years in prison in each case. He then filed these appeals.
In August 2017, we ordered court reporter Martha Grant to file a supplemental reporter's record containing the items requested in appellant's June 8, 2017 "Supplemental Request for Preparation of Reporter's Record and Designation of Matters to be Included." Although a supplemental reporter's record of the September 2014 hearing was filed on September 25, 2017, it did not contain the seven exhibits offered and admitted at the September 2014 hearing.
After appellant filed a motion to abate the appeal because of the missing exhibits, we ordered court reporter Martha Grant to file, by October 30, 2017, a supplemental reporter's record containing the seven exhibits offered and admitted at the September 24, 2014 hearing. We cautioned Ms. Grant that the failure to file the reporter's record by that time would result in the Court taking whatever remedies it has available, including ordering that she not sit until the complete reporter's record in this appeal is filed. To date, the supplemental reporter's record has not been filed, and we have had no communication from Ms. Grant.
Therefore, we ORDER that Martha Grant NOT SIT as a court reporter until she has filed the supplemental reporter's record containing the seven exhibits offered and admitted at the September 24, 2014 hearing.
We DIRECT the Clerk to send copies of this order to the Honorable Andrea Martin, Presiding Judge, 304th Judicial District Court; to Martha Grant, official court reporter of the 304th Judicial District Court; to the Dallas County Auditor's Office; and to counsel for all parties.
