ROBERT DAVIS v. SECRETARY OF STATE

LC No. 24-000069-MB

ORDER

Stephen L. Borrello, Chief Judge Pro Tem, acting under MCR 7.203(F)(1), orders:

The claim of appeal is DISMISSED for lack of jurisdiction. Contrary to the claim of appeal's indication that appellant is an intervening defendant in this case the order appealed from and trial court register of actions show that she is not a party to this case, but rather was merely allowed by the trial court to file an amicus curiae brief. Thus, this Court lacks jurisdiction over the claim of appeal because appellant is not an aggrieved party. MCR 7.203(A); Burton-Harris v Wayne Co Clerk, 508 Mich. 985; 966 N.W.2d 349 (2021) (holding that a person who was never a party to a case could not seek appellate review of trial court's denial of the plaintiff's denial of a request for mandamus and declaratory relief).
