Platkin, the Presiding Justice of the Commercial Division in Albany County, concluded as follows: "In any event, standing to pursue a derivative claim on behalf of a corporation requires status as a shareholder, and standing to pursue a derivative claim on behalf of a limited liability company requires status as a member (Tzolis v Wolff, 10 NY3d 100)."
