RONALD LYNN DAVIS, Petitioner v. COMMISSIONER OF INTERNAL REVENUE, Respondent

ORDER

Elizabeth Crewson Paris Judge.

This case is calendared for trial at the Mobile, Alabama, Trial Session of the Court beginning February 21, 2024.

On January 5, 2024, docket entry 15, respondent filed a Motion for Continuance of Trial. Respondent's Motion indicates that petitioner has another case before the Court at Docket No. 18676-19L, which respondent has requested that this Court remand to the IRS Office of Independent Appeals (Appeals). Once Appeals has considered the case at Docket No. 18676-19L on remand, respondent believes this case may be rendered moot. Therefore, respondent requests that the Court continue this case pending the outcome of Appeals' consideration of the case at Docket No. 18676-19L.

After due consideration, it is

ORDERED that jurisdiction of this case is retained by this Division of the Court. It is further

ORDERED that respondent's Motion for Continuance of Trial, filed January 5, 2024, docket entry 15, is granted in that this case is stricken for trial from the February 21, 2024, Mobile, Alabama, Trial Session of the Court, and this case is continued. It is further

ORDERED that, on or before May 24, 2024, the parties shall file a Joint Status Report (or, if that is not possible, then separate reports) with the Court as to the then-present status of this case.
