MICHAEL DAVIS & AMY L. DAVIS, ET AL., Petitioners v. COMMISSIONER OF INTERNAL REVENUE, Respondent

ORDER

Christian N. Weiler, Judge

On January 23, 2023, respondent filed a motion to compel production of documents. By order served on January 26, 2023, the Court directed petitioners to respond and produce the requested information or if respondent's requests are objectionable or the motion should be denied in whole or in part for any other reason, petitioners should so advise the Court in writing.

On February 17, 2023 petitioners filed their response indicating they had provided the requested information. On February 25, 2023, March 3, 2023, and March 15, 2023 respondent filed status reports, updating the Court as to remaining issues with respect to his motion to compel. In his final status report, respondent indicates a dispute remains over the production of the appraisal file of Mr. Clayton Weibel. Respondent maintains the said file is in petitioners' possession, custody or control and therefore should be produced by petitioners.

To enable the Court to resolve the discovery dispute, it is

ORDERED that on or before March 31, 2023, petitioners shall file with the Court and serve on counsel for respondent a supplemental response to respondent's motion to compel production of documents, as it relates to the production of the appraisal file of Mr. Clayton Weibel.
