This consolidated case is calendared for a remote trial at the session of the Court scheduled to commence on October 18, 2021, for cases in which Dallas, Texas, is the place of trial.

On August 31, 2021, at 8:41 a.m., respondent filed a motion for order to show cause why proposed facts and evidence should not be accepted as established pursuant to Rule 91(f). On the same day, at 8:54 a.m., respondent filed an additional motion for order to show cause why proposed facts and evidence should not be accepted as established pursuant to Rule 91(f). Upon review of respondent's motions, it appears to the Court that respondent's motion for order to show cause filed August 31, 2021, at 8:54 a.m. is duplicative of respondent's motion for order to show cause filed on August 31, 2021, at 8:41 a.m. Accordingly, respondent's duplicative motion shall be stricken from the record.

Upon due consideration, it is

ORDERED that respondent's motion for order to show cause why proposed facts and evidence should not be accepted as established pursuant to Rule 91(f) filed August 31, 2021, at 8:54 a.m., at Docket Index No. 42, is hereby stricken from the record. It is further

ORDERED that, on or before September 27, 2021, petitioner shall file a response to respondent's motion for order to show cause why proposed facts and evidence should not be accepted as established pursuant to Rule 91(f) filed August 31, 2021.
