Opinion
Civil Action No. 99-1055-S
March 23, 2001
ORDER
This cause is before the Court on Plaintiff's Application for an Award of Attorney Fees (Doc. 52); Plaintiff's Memorandum in Support of Application for an Award of Attorney Fees (Doc. 53); Affidavit of Michael S. McNair, Plaintiff's Trial Attorney, in Support of Plaintiff's Application for Attorney Fees (Doc. 54); and Defendant, Baroco Electric Construction Company, Inc.'s Objection to Plaintiff's Application for an Award of Attorney's Fees (Doc. 58).
Upon consideration of all matters presented, this Court finds that Plaintiff is a "prevailing party" within the meaning of 42 U.S.C. § 2000e-5 (k). The Court further finds that the hourly rate requested by Plaintiff's counsel ($150.00 per hour), and the total amount of time expended by counsel in this action (93.50 hours) are reasonable given the nature and circumstances of this action. Therefore, Plaintiff's Application for an Award of Attorney Fees is GRANTED, and Plaintiff is hereby authorized to collect from Defendant Baroco Electrical Construction Company attorney's fees in the amount of $14,025.00.
