Summary
In Akin v. Davis, 11 Kan. 580, it was held that where a person builds a dam and thereby causes a stream of water to rise so as to overflow another's land to his damage, such person has at least two causes of action, first, a legal cause of action for the injuries already caused by the dam; second, an equitable cause of action to restrain by injunction, the further maintenance and continuance of the dam.
