Order and judgment reversed upon the law and new trial granted, costs to abide the event. We are of opinion that the question of defendant's negligence and plaintiff's contributory negligence and assumption of risk were questions of fact for the jury. Lazansky, P.J., Young, Hagarty, Seeger and Carswell, JJ., concur.
