NO. 14-15-00944-CV (Tex. App. Feb. 2, 2016)

Opinion

DAVID SOLIZ AND SOLIZ AUTOMOTIVE, INC., Appellant v. DARWIN HANEY, Appellee

On Appeal from the 270th District Court Harris County, Texas
Trial Court Cause No. 2013-55761

ORDER

On January 21, 2016, this court issued an opinion dismissing this appeal because appellants had not provided proof that they had paid for or arranged to pay for the clerk's record. On January 27, 2016, the clerk's record was filed.

Accordingly, on its own motion, the court orders as follows:

This court's opinion filed January 21, 2016, is WITHDRAWN, and our judgment of that date is VACATED. The appeal is REINSTATED.

The court does not know if appellants have arranged for the reporter's record to be filed. Unless appellants provide proof by February 17, 2016, that they have paid or arranged to pay for the reporter's record, we may consider and decide those issues or points that do not require a reporter's record. See Tex. R. App. P. 37.3(c).
