DECISION AND ORDER ON MOTION
Motion to substitute Daniel M. Martuscello, as executor of the estate of the plaintiff, as appellant upon the appeal and to amend the summons, pleadings and proceedings.
Upon the papers filed in support of the motion, and no papers having been filed in opposition thereto, it is
ORDERED that the motion is granted, without costs, only to the extent that Daniel M. Martuscello, as executor of the estate of plaintiff, is substituted as appellant upon the appeal, and the motion is, in all other respects, denied.
